The FDA's Final Rule


On June 30th the FDA's “Final Rule” goes into effect. This means that claims can no longer be brought against pharmaceutical companies for any damages consumers of drugs may claim as their fault, or cause of the onset of other serious diseases.
This is a blow to both the consumer and the attorneys, both of whom have already spent years of time, years of suffering – and now loss of health and loss of millions of dollars for the production of winning court cases and class action suits.

The new rule actually has the strength to bypass laws already enacted. Plus, Congress no longer can come to the rescue. The consumer is now out there in Limbo alone, ill, hurting and most of all without recourse.

Who composes the FDA Department? Where does the buck stop, or is it one of those nebulous institutions who has the power to plough roughshod over the common man – the man who's voice is never heard? How does any branch of the US government receive the power of such scope? Is this Russia?
The FDA claims that once they have approved of the release of a new drug for public consumption their decision is infallable. Their “implied” safety by their approval has the puissance, the vigor, the perogative of the strength of an imperial ruler, one who's decision can never again be challenged.

The problem is: in court on July 6th, 2006 presiding Judge Carol Higbee said that the FDA had “nothing whatever to do with science.” To this layman that means that a bunch of men making up their minds that a new drug is a good drug, and without a majority with a science background the FDA is definitely out of order.
This new cog in the wheel seems to shut out the Supreme Court and, I might add, it's against our own Constitution.

The FDA has become a loose cannon and Americans should see it for what it really is; a threat to the health and safety of everyone.

When death and suffering is mounting daily from the effects of drugs passed, some on the very edge, can this be called murder? Why not? Hundreds of thousands have died – that's spelled D-I-E-D -
by the bloody hands of a government facility who have now declared themselves a god.
It's as though our government had stood them all in front of a firing squad, but now we add the word “willfully.”
This gives the FDA no responsibility whatever. They've washed their own hands. This also declares that the FDA is just another corrupt department in this government's stable.
